The cancellation period is fourteen days from the day on which you or a third party designated by you who is not the carrier have or has taken possession of the goods. Insofar as within the framework of a uniform order the goods ordered are being delivered separately, the taking of possession of the last of the goods is decisive.
In order to exercise your right of cancellation, you have to inform us (HQ Media Vertrieb GmbH, Thomas-Wimmer-Ring 11, D-80539 Munich, phone +49/89/24234803, telefax +49/89/29088160, e-mail: email@example.com) by way of an unequivocal declaration (e.g. a letter sent by mail, a telefax letter or an e-mail) about your decision to revoke this contract. For this purpose you may use the enclosed sample cancellation form, however, this is not compulsory.
You may also electronically fill in and transmit the sample cancellation form or another unequivocal declaration on our website www.hqmedia.de. If you use this option, we will immediately (e.g. via e-mail) send you an acknowledgement of the receipt of such a cancellation.
To observe the cancellation period it is sufficient to send the notice of exercise of the right of cancellation prior to the expiry of the cancellation period.
Consequences of the Cancellation
If you cancel this contract, we have to repay to you all payments which we received from you, including the delivery costs (with the exception of any additional costs resulting from you choosing another type of delivery than the economical standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notice about your cancellation of this contract. For such repayment we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will any fees be charged to you due to this repayment. We may refuse repayment until the goods have been returned to us or until you have furnished us with evidence that you have returned the goods, whichever may be the earlier point of time.
You have to send back or deliver the goods without delay and in any case at the latest within fourteen days from the day on which you inform us about the cancellation of this contract to VVA Remittendenstelle, Warenannahme 500, Henkenstr. 59-65, D-33415 Verl. The time limit has been observed if you send the goods prior to the expiry of the fourteen-day time limit. You bear the direct costs of the return of the goods.
You only have to compensate for a possible loss of value of the goods if such loss of value is due to your handling the goods in a way that is not required for examining the quality, features and functionality of the goods.
End of the cancellation policy.
EXCLUSION OF THE RIGHT OF CANCELLATION
1. The right of cancellation does not apply for distance contracts for the delivery of audio or video recordings or software insofar as the delivered data carriers have been unsealed by the consumer.
2. The right of cancellation does not apply for goods that have been transmitted in digital form (i.e. via download). This has been pointed out to you prior to the performance of the contract.
